Bourke v. Beshear - Litigating Kentucky Marriage Laws

In October of this year, my law firm joined the case of Bourke v. Beshear, a challenge to several Kentucky laws (and also the federal Defense of Marriage Act) which prohibit the recognition of valid same-sex marriages from other states.

The presiding federal judge in the case has set an accelerated filing schedule. Yesterday we filed our Motion for Summary Judgment and Permanent Injunction. In support, we also filed a Memorandum of Law which explains the basis for our clients' challenge to the laws which discriminate against their valid marriages solely on the basis of their sexual orientation.
